Appellant Chris Otting was charged in count one of the indictment with capital murder of a child under the age of six years. Count two alleged that the appellant intentionally or knowingly caused serious bodily injury to a child under the age of fourteen years by smothering, suffocating, or choking the child with a blanket, hand, or unknown object. The jury convicted appellant of reckless injury to a child, a lesser included offense under count two, and made an affirmative finding that a deadly weapon had been used as alleged in the indictment. The jury assessed punishment at 20 years imprisonment and a fine of $10,000.
